Goldentia Home Care Services Terms & Conditions

Terms & Conditions

 

These Terms and Conditions (“Terms”) form an integral part of every service request submitted to Goldentia Home Care Services for the provision of non-medical homecare services to one or more individuals. In this document, the person or entity requesting services is referred to as “you,” while Goldentia Home Care Services, the provider of such services, is referred to as “we,” “us,” or “our,” and the individual receiving the services is referred to as the “Client.”


Ordering services from us and accessing or using the services provided is strictly subject to your acceptance of and adherence to these Terms. We strongly encourage you to read these Terms thoroughly before submitting any service request or engaging with our services. By placing a service request or utilizing our services, you signify your full and unconditional agreement to comply with these Terms. 



1. Scope and Definition of Support Offered

Our services include non-medical assistance such as companionship, help with daily living activities, light housekeeping, meal preparation, and similar personal support tasks, as mutually agreed upon at enrolment. Medical, nursing, or regulated health services are not provided under this Agreement.  If your needs change or become medical in nature, you agree to seek appropriate professional healthcare advice or assistance.


2. Client’s Commitment to Remit Payment

You agree to pay all fees specified in your individualized service schedule or invoice, in Canadian dollars. Fees are due as set out in your care agreement and invoices. Services may be paused or discontinued for overdue accounts.


3. Arrangements for Visits, Changes, and Timely Notices

Requests to schedule, modify, or cancel services must be submitted at least 24 hours before your scheduled appointment. Short-notice cancellations or missed appointments may incur a cancellation fee, as specified in your service agreement.


We aim to accommodate rescheduling requests subject to staff availability. Repeated cancellations or no-shows may result in review or suspension of ongoing service arrangements.


4. Limitation of Responsibility

We do not accept liability for any indirect, consequential, or incidental damages arising from the provision of our services, except where required by law. Our liability is limited to the amount paid by the Client for the affected services during the most recent billing cycle.


5. Unexpected Events Beyond Control

Neither party will be held liable for delays or failures due to events outside their reasonable control, including but not limited to natural disasters, emergencies, government orders, or significant illness or injury (“Force Majeure”). Service obligations may be suspended for the duration of such an event.


6. Client Assurance and Responsibility

You agree to indemnify and hold us harmless from any claims, liabilities, or expenses arising from your conduct, misuse of services, or violation of these terms, except to the extent caused by our documented breach or negligence.


7. Independence of Provisions

If any provision of this policy is found unenforceable, the remaining terms continue in full force and effect. The invalid provision will be interpreted, where possible, to reflect the intent of the parties.


8. Entire Understanding

This document, along with any signed client agreements, forms the full and exclusive agreement between you and Goldentia Home Care Services regarding homecare services. Any prior agreements, statements, or representations, verbal or written, are superseded by these terms.


9. Application of Provincial and Federal Laws

These terms are governed by and construed in accordance with the laws of the Province of Ontario and applicable federal laws of Canada. Any disputes arising from this policy will be resolved in the courts of Ontario.


10. Protection of Client Information

We collect and safeguard your personal information in compliance with Ontario’s privacy laws, including the Personal Health Information Protection Act (PHIPA), as applicable. Your information will only be used for the provision and administration of services, or as required by law. Please see our [Privacy Policy] for more detail.


11. Duration and Termination of Support Services

This policy is effective upon your engagement with our services and remains in effect until terminated by either party. You may end services by providing written notice at least [insert number] days in advance. We reserve the right to terminate services at our discretion upon written notice, including for non-payment, non-compliance with these terms, or safety concerns.


 

12. Eligibility

You must be at least the age of majority in Ontario to use our Website and request services. If arranging care on behalf of another, you confirm you have the legal authority to do so.



13. Professional Standards & Compliance

All services are provided in alignment with the Home Care and Community Services Act, 1994 and applicable Ontario regulations. We are committed to providing services free from discrimination and in accordance with Ontario’s Human Rights Code.


14. Privacy and Confidentiality

We respect your privacy. All personal information is collected, used, and disclosed in accordance with our Privacy Policy, and applicable privacy laws in Ontario.

  • Client information will be kept strictly confidential except where disclosure is required or permitted by law.
  • By using our services, you consent to the collection and use of your information for the purposes of service provision, quality assurance, and regulatory compliance.


15. User Responsibilities

By using our Website and engaging with our Services, you agree to:

  • Provide accurate, complete information when requesting services.
  • Use the Website and Services only for lawful, personal, non-commercial purposes.
  • Not use our Website in any manner that could harm, disable, overload, damage, or interfere with any other party’s use.
  • Not attempt to gain unauthorized access to any accounts, systems, or networks connected to the Website.


16. Account Security

Some features may require you to create an account:

  • You are responsible for maintaining the confidentiality and security of your login information.
  • Notify us immediately of any unauthorized use or security breach related to your account.
  • We are not liable for any loss arising from unauthorized account use.


17. Service Availability and Limitations

  • Service scheduling is subject to availability. We reserve the right to refuse, limit, or discontinue services at our sole discretion, including for compliance and safety reasons.
  • We do not guarantee uninterrupted or error-free Website or service operation.


18. Service Fees and Payment (if applicable)

  • All fees for services will be disclosed before confirmation. Fees are subject to change with notice.
  • Payments are due as agreed in your service arrangement. Late or non-payment may result in suspension or cancellation of services.
  • No payment is accepted for non-medical security checks or reassurance visits combined with government-funded services, as required by Ontario law.


19. Third-Party Content and Links

Our Website may contain links to third-party websites for your convenience. We do not endorse, and are not responsible for, the content, policies, or practices of such third parties.


20. Intellectual Property

All content on this Website, including text, graphics, logos, and designs, is the property of Goldentia Home Care Services, unless otherwise stated, and is protected by Canadian copyright and trademark law. You may not use, reproduce, or distribute any content without our express written permission.


21. Disclaimers and Limitation of Liability

  • All services are provided “as is” and “as available.” We expressly disclaim any warranties of fitness for a particular purpose or non-infringement, to the maximum extent permitted by law.
  • We are not liable for any indirect, incidental, or consequential loss arising from your use of the Website or our Services.

Nothing in these Terms is intended to restrict your statutory rights as a consumer under Ontario law.


22. Indemnification

You agree to indemnify and hold harmless Goldentia Home Care Services and its employees, contractors, and agents from any claim, demand, or damage, including reasonable legal fees, arising from your use of this Website or Services, or your breach of these Terms.


23. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted to the Website with the new effective date. Continued use of the Website or Services after changes signifies acceptance of the revised Terms.


24. Complaints and Dispute Resolution

  • If you have concerns about service quality or conduct, contact us directly using the information below. We follow a formal complaints process in line with Ontario regulations, including review and remediation as appropriate.
  • These Terms shall be governed by the laws of Ontario and federal laws of Canada, as applicable. Any disputes will be subject to the exclusive jurisdiction of the courts of Ontario.


Obligations related to confidentiality, indemnity, and payment for services rendered will survive the termination of this Agreement.
